{"id":4165,"date":"2013-09-02T08:00:53","date_gmt":"2013-09-02T12:00:53","guid":{"rendered":"http:\/\/www.nchealthplans.com\/news\/?p=4165"},"modified":"2013-08-27T10:17:25","modified_gmt":"2013-08-27T14:17:25","slug":"changes-to-ncs-small-employer-group-health-coverage-reform-act-related","status":"publish","type":"post","link":"https:\/\/www.nchealthplans.com\/news\/2013\/09\/changes-to-ncs-small-employer-group-health-coverage-reform-act-related\/","title":{"rendered":"Changes to NC&#8217;s Small Employer Group Health Coverage Reform Act Related"},"content":{"rendered":"<h2><a href=\"https:\/\/www.nchealthplans.com\/news\/wp-content\/uploads\/2013\/01\/bigstock-Business-Group-Portrait-25957261.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-medium wp-image-3955\" title=\"Business group portrait\" src=\"https:\/\/www.nchealthplans.com\/news\/wp-content\/uploads\/2013\/01\/bigstock-Business-Group-Portrait-25957261-300x225.jpg\" alt=\"\" width=\"300\" height=\"225\" srcset=\"https:\/\/www.nchealthplans.com\/news\/wp-content\/uploads\/2013\/01\/bigstock-Business-Group-Portrait-25957261-300x225.jpg 300w, https:\/\/www.nchealthplans.com\/news\/wp-content\/uploads\/2013\/01\/bigstock-Business-Group-Portrait-25957261.jpg 900w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \><\/a>Federal and NC Definitions Now Aligned<\/h2>\n<p>Date: 08\/23\/2013<\/p>\n<p class=\"MsoNormal\" style=\"margin: 0in 0in 10pt;\"><span style=\"font-size: 10pt; line-height: 115%; font-family: 'Arial','sans-serif';\">Recently, the North Carolina (NC) legislature passed<\/span> <a href=\"http:\/\/www.ncleg.net\/Sessions\/2013\/Bills\/House\/PDF\/H649v7.pdf\"><span style=\"font-size: 10pt; line-height: 115%; font-family: 'Arial','sans-serif';\"><span style=\"color: #800080;\">House Bill 649<\/span><\/span><\/a><span style=\"font-size: 10pt; line-height: 115%; font-family: 'Arial','sans-serif';\">,  which made changes to NC\u2019s Small Employer Group Health Coverage Reform  Act in order to align federal and NC definitions related to <a href=\"http:\/\/www.nchealthplans.com\" target=\"_blank\">small  employer group health plans<\/a> \u2013 specifically, those definitions included  as part of the Affordable Care Act.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0in 0in 10pt;\"><span style=\"font-size: 10pt; line-height: 115%; font-family: 'Arial','sans-serif';\">Important changes affecting <a href=\"http:\/\/www.nchealthplans.com\" target=\"_blank\">BCBSNC<\/a> employer groups beginning January 1, 2014 include:<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0in 0in 10pt;\"><strong style=\"mso-bidi-font-weight: normal;\"><span style=\"font-size: 10pt; line-height: 115%; font-family: 'Arial','sans-serif';\">Sole Proprietorship Change<\/span><\/strong><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0in 0in 0pt; line-height: normal;\"><span style=\"font-size: 10pt; font-family: 'Arial','sans-serif';\">Self-employed individuals (or sole proprietors) with no<\/span> <a href=\"http:\/\/www.irs.gov\/Businesses\/Small-Businesses-&amp;-Self-Employed\/Employee-%28Common-Law-Employee%29\"><span style=\"font-size: 10pt; font-family: 'Arial','sans-serif';\">common-law<\/span><\/a><span style=\"font-size: 10pt; font-family: 'Arial','sans-serif';\"> employees are no longer eligible for non-grandfathered small employer  health plan coverage; conversely, a sole proprietor is eligible for  group coverage if there is at least one common law employee (e.g.,  non-family member, etc.)<\/span><span style=\"color: red;\"><span style=\"font-family: Calibri;\"> <\/span><\/span><span style=\"font-size: 10pt; font-family: 'Arial','sans-serif';\">employed.<\/span><\/p>\n<p style=\"margin-bottom: 0pt;\"><span style=\"font-size: 10pt; font-family: 'Arial','sans-serif';\"><!--more--><br \>\nUnder  the new law, self-employed individuals who are currently on a small  group plan will not be able to renew their small group plan when their  current policy period ends. At that point, they can enroll in an  individual product rather than a small group health policy.\u00a0If the  individual\u2019s current <a href=\"http:\/\/www.nchealthplans.com\" target=\"_blank\">small group plan<\/a> renews outside of the Annual  Enrollment Period (which begins on October 1, 2013 for plans effective  in 2014), they could still enroll in an individual product under a  special enrollment period.<\/span><span style=\"color: #1f497d;\"> <\/span><span style=\"font-size: 10pt; font-family: 'Arial','sans-serif'; mso-bidi-font-weight: bold;\">They  can obtain one of these policies either through an appointed agent, the  federally-facilitated Exchange or by contacting a <a href=\"http:\/\/www.nchealthplans.com\" target=\"_blank\">BCBSNC<\/a> representative.<\/span><\/p>\n<p style=\"margin-bottom: 0pt;\"><span style=\"font-size: 10pt; font-family: 'Arial','sans-serif';\"> <\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0in 0in 10pt;\"><strong style=\"mso-bidi-font-weight: normal;\"><span style=\"font-size: 10pt; line-height: 115%; font-family: 'Arial','sans-serif';\">Full-Time Equivalent Employees<\/span><\/strong><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0in 0in 10pt;\"><span style=\"font-size: 10pt; line-height: 115%; font-family: 'Arial','sans-serif';\">House  Bill 649 states that \u201cthe number of employees shall be determined using  the method set forth in section 4980H(c)(2) of the Internal Revenue  Code.\u201d (A link to this section of the Internal Revenue Code can be found<\/span> <a href=\"http:\/\/www.irs.gov\/irb\/2011-21_IRB\/ar07.html\"><span style=\"font-size: 10pt; line-height: 115%; font-family: 'Arial','sans-serif';\">here<\/span><\/a><span style=\"font-size: 10pt; line-height: 115%; font-family: 'Arial','sans-serif';\">.)<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0in 0in 10pt;\"><span style=\"font-size: 10pt; line-height: 115%; font-family: 'Arial','sans-serif';\">In linking the employee count to the method set forth by the IRS, this law clarifies that full-time <strong style=\"mso-bidi-font-weight: normal;\">equivalent<\/strong> employees, which are determined based on the hours of service of employees who are not full-time, are taken into account.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0in 0in 10pt;\"><strong style=\"mso-bidi-font-weight: normal;\"><span style=\"font-size: 10pt; line-height: 115%; font-family: 'Arial','sans-serif';\">Common Ownership Change<\/span><\/strong><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0in 0in 0pt; line-height: normal;\"><span style=\"font-size: 10pt; font-family: 'Arial','sans-serif'; mso-fareast-font-family: 'Times New Roman';\">Currently,  if a subsidiary company that has a separate tax ID number applies for a  group policy and the subsidiary has fewer than 51 full-time employees  (FTEs), but the subsidiary combined with the parent company has more  than 50 FTEs, then the subsidiary company would be considered a small  group even though the total number of FTEs is above the <a href=\"http:\/\/www.nchealthplans.com\" target=\"_blank\">small group<\/a> threshold.<br style=\"mso-special-character: line-break;\" \><br style=\"mso-special-character: line-break;\" \><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0in 0in 0pt; vertical-align: middle; line-height: normal;\"><span style=\"font-size: 10pt; font-family: 'Arial','sans-serif'; mso-fareast-font-family: 'Times New Roman';\">Under  the new NC law, if a subsidiary has fewer than 51 full-time or  full-time equivalent employees, but the subsidiary combined with the  parent has more than 50 full-time or full-time equivalent employees,  then the subsidiary would be considered a large group, even if the  subsidiary has a separate tax ID number from the parent company and were  to get their own policy separate from the parent company.<br style=\"mso-special-character: line-break;\" \><br style=\"mso-special-character: line-break;\" \><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0in 0in 0pt; vertical-align: middle; line-height: normal;\"><span style=\"font-size: 10pt; font-family: 'Arial','sans-serif'; mso-fareast-font-family: 'Times New Roman';\">Under  this new law, <a href=\"http:\/\/www.nchealthplans.com\" target=\"_blank\">BCBSNC<\/a> must now know if a group is part of a controlled  group that qualifies as a single employer and if so, how many full-time  or full-time equivalent employees are employed by the consolidated  group.
